1. Acceptance of Terms

By accessing or using CensusGreeter's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

CensusGreeter provides AI-powered voice communication services for senior care and healthcare organizations, including automated call handling, appointment scheduling, and inquiry management.

Customers who are HIPAA Covered Entities are also subject to our Business Associate Agreement.

3. User Responsibilities

You agree to provide accurate information when using our services and to maintain the confidentiality of your account credentials. You are responsible for all activities that occur under your account.

4. Acceptable Use

You may not use CensusGreeter services to: (a) violate any applicable laws or regulations; (b) transmit harmful, fraudulent, or deceptive content; (c) interfere with or disrupt the integrity of our services; or (d) attempt to gain unauthorized access to our systems.

5. Service Availability

While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

5A. Service Usage and Call Limits

Each subscription plan includes a specified number of AI receptionist calls per billing cycle as stated on the pricing page at the time of purchase. Usage beyond the included call allocation is billed at the per-call overage rate published on the pricing page.

We will notify you by email when your usage reaches 90% of your plan's included calls. Overage charges appear on your next invoice.

We reserve the right to modify call limits and overage rates with 30 days' advance written notice. Continued use after the effective date constitutes acceptance. If you do not agree, you may cancel per Section 9.

Call limits reset at the beginning of each billing cycle. Unused calls do not roll over.

6. Payment Terms

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as explicitly stated in our 30-day money-back guarantee for new subscribers.

7. Intellectual Property

All content, features, and functionality of CensusGreeter services are owned by CensusGreeter and are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without prior written consent.

8. Limitation of Liability

CensusGreeter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through our service. Continued use after changes constitutes acceptance of the new terms.
